Our Collection Procedure
Once a case file is placed with Burnard, Raaff & Associates, the following steps take place:

Contact debtor via telephone, letter or email. The debtors are contacted every month to remind them of the payment that is due, all is required during this first stage.

If unsuccessful during the first stage, the debtor is visited by an agent and an Acknowledgement of Debt, a Demand for payments as well as Consent to Judgement and all other legal documents are signed.

Once the court has granted an Emoluments Attachment Order, it is served on the debtor's employer by the Sheriff. The employer is then legally obligated to deduct the instalment amount of the Order from the debtor.s salary or wages on a monthly/weekly basis and pay it over to ourselves.

A Summons may be obtained in the case where a debtor refuses to make payment.

Provision is made in the documents for collection fees, as well as costs and disbursements that comply with the rules and regulations of the National Credit Act of South Africa. These fees are added to the capital debt whereby the debtor and not the client will be held liable for the payment of these fees.

Upon receipt of payments from the debtor's employers in accordance with the Emolument Attachment Orders, we pay as a sum over to the client once a month after deducting the agreed upon commission plus VAT, unless otherwise agreed.

The client will receive an Invoice of our commission as well as a schedule of all payments made reflecting the account number, debtor name and amount paid.

Should a debtor not be employed we will do the normal collections from such debtor. All collections are done based on a no collection, no commission basis.
